1.1. We appreciate your use of TwoFingers. Fayte Entertainment Limited, company number 14959635, operates a mobile application called “TwoFingers,” which is available for download on your mobile device (the “TwoFingers App”). The app allows users to make new connections and engage in discussions with new friends (the “TwoFingers Service” or “Service”).

1.2. The TwoFingers Service is provided by TwoFingers (“TwoFingers,” “we,” “our,” or “us”). Your utilization of the TwoFingers Service and any services provided through or related to it are governed by these Terms and Conditions.

Description of the TwoFingers Service

5.1. The TwoFingers Service is an app that enables users to make instant connections and engage in discussions with new friends.

5.2. When utilizing any of these features, you must comply with our Rules of Acceptable Use as detailed below.

Setting up your account To use TwoFingers, you must be 13 or older. After installing the TwoFingers App, you’ll need to create an account and provide personal information. Your account and personal information are crucial, so keep them safe and accurate.

6.1. To access the TwoFingers Service, you must download the TwoFingers App on your device. Some features are accessible only by setting up an account, including entering your phone number, verifying the code sent to you, and choosing a username and password (your “Account”). You’ll also need to provide contact details, including your email address.

6.2. You must be thirteen (13) years or older and legally capable of entering into a binding agreement under the laws of your country of residence to use the TwoFingers Service.

6.3. You’re responsible for maintaining the confidentiality of your login details and any activities occurring under your Account. If you suspect misuse of your Account, contact us at support@twofingers.app immediately.

6.4. You agree not to create an account using false information or on behalf of someone else. You may only have one Account, which is personal and cannot be transferred or lent to others. Keep your Account information confidential and secure.

Your right to use the TwoFingers Service

Enjoy using TwoFingers, but ensure compliance with the rules. You must not allow others to use your account or use any content that isn’t yours for purposes other than using TwoFingers. Report any inappropriate content you encounter.

7.1. Materials and content within the TwoFingers Service (excluding User Content) belong to us or our licensors. You’re permitted to use these materials and content solely for using the TwoFingers Service as outlined in these Terms.

7.2. Your right to use the TwoFingers Service is personal and cannot be transferred to others.

7.3. Unless permitted by these Terms or the TwoFingers Service’s functionality, you agree:

  • Not to copy or attempt to copy the TwoFingers App or any portion of the TwoFingers Service.
  • Not to provide, sell, or make available the TwoFingers App or any portion of the TwoFingers Service to others.
  • Not to modify or attempt to modify the TwoFingers App or any portion of the TwoFingers Service.
  • Not to access, copy, distribute, or use any code of the TwoFingers App or any portion of the TwoFingers Service not publicly published for general use.

7.4. All intellectual property rights in the TwoFingers App or any portion of the TwoFingers Service belong to us or our licensors.

7.5. You acknowledge having no rights in or to the TwoFingers App or any portion of the TwoFingers Service except for the right to use and access them according to these Terms.

Purchases and subscriptions

TwoFingers allows you to make purchases and subscriptions directly within the app. These transactions are contractual, and you must be legally competent to make them or have parental permission. Make sure to cancel any subscriptions you don’t want to renew.

8.1. Purchasing products, services, and/or game subscriptions (referred to as “In-app Purchase” and/or “Subscriptions”) from the TwoFingers App is governed by these Terms.

8.2. By making an In-App Purchase or Subscription, you’re making a legally binding offer to enter into a contract. You confirm your legal capacity to enter into a contract or obtain permission from your parents or legal guardian.

8.3. Purchasing Subscriptions or In-App Purchases from Apple or Google: Subscriptions and in-app purchases are managed by the Apple AppStore or Google PlayStore, not TwoFingers. These transactions are subject to the terms and conditions of Apple or Google. TwoFingers does not have access to users’ accounts or transactions. If you need to verify the type of subscription purchased, review your account or receipt, as each subscription has a unique billing name.

In-game purchases on mobile devices utilize the payment method stored in your Apple App Store or Google Play account. For further details, refer to Apple’s or Google’s support articles.

8.4. Auto-renewal Subscriptions: TwoFingers may offer users the option to purchase weekly or monthly subscriptions for accessing specific services or features. Users will be charged the subscription fee within twenty-four (24) hours before the current billing period ends. Subscriptions are automatically renewed unless canceled at least twenty-four (24) hours before the end of the current period. It’s your responsibility to monitor billing periods and renewals.

The subscription price is final and non-refundable, except as required by law. You can manage automatic renewal settings in your Apple Account settings.

8.5. Termination of the Subscription by the User:

  • Most subscriptions renew automatically unless canceled.
  • If canceled, you can still use the subscription until the end of the current billing period.
  • Canceling during a trial period may result in immediate loss of access to content.
  • To avoid renewal, cancel free or discounted trial subscriptions at least 24 hours before the trial period ends.

8.6. Termination of the Subscription by TwoFingers: TwoFingers may cancel, suspend, or terminate a user’s access to subscribed services if:

  • The user violates the Terms.
  • Unlawful activity is associated with the user.
  • Fraud or misuse is suspected.

Apple App Store Provisions:

If you downloaded TwoFingers from the Apple App Store, note that Apple has no responsibility for the app or its content. However, you must comply with the App Store Terms of Service.

9.1. If TwoFingers was downloaded from the Apple App Store, acknowledge that these Terms are solely between you and TwoFingers, not Apple Inc. Ensure compliance with the App Store Terms of Service.

Understand that Apple has no obligation to provide maintenance and support for TwoFingers. If the app fails to meet warranties, you may contact Apple for a refund. However, Apple has no further warranty obligations regarding TwoFingers. Any claims related to the app are governed by these Terms of Service and applicable laws.

9.2. Apple is not responsible for addressing claims related to TwoFingers or your use of the app, including product liability claims or legal requirements. Any such claims are subject to these Terms of Service and relevant laws.

9.3. In case of third-party claims regarding intellectual property rights infringement, TwoFingers, not Apple, is responsible for investigation, defense, settlement, and discharge as per these Terms of Service.

9.4. You confirm compliance with U.S. government regulations regarding country of residence and prohibited parties.

9.5. Apple and its subsidiaries are third-party beneficiaries of these Terms concerning your license of TwoFingers, giving Apple the right to enforce these Terms against you.

Other App Marketplaces and Platforms: If you downloaded TwoFingers from a platform other than the Apple App Store, that platform bears no responsibility for the app or its content. However, you must adhere to the platform’s terms of service.

10.1. If TwoFingers was downloaded from a platform other than the Apple App Store, such as the Google Play Store, recognize that these Terms apply between you and TwoFingers, not the platform provider. Comply with the platform’s Terms of Service for using TwoFingers.

10.2. The platform provider is solely a distributor of TwoFingers, not its owner. TwoFingers is responsible for the app, not the platform provider.

10.3. The platform provider has no liability or obligation regarding TwoFingers or these Terms.

10.4. The platform provider is a third-party beneficiary of these Terms concerning TwoFingers.

Your Content:

Ensure that all content you post on TwoFingers is your own and complies with our Rules of Acceptable Use. TwoFingers uses your content solely to provide the service and respects your rights and privacy. However, for safety purposes, TwoFingers monitors and controls posted content. Your use of TwoFingers is at your own risk.

11.1. Your User Content on TwoFingers should adhere to our Rules of Acceptable Use.

11.2. TwoFingers does not claim ownership of your User Content. You retain ownership of your content, and by using the service, you grant TwoFingers a worldwide, non-exclusive, royalty-free, and perpetual license to use, copy, reproduce, distribute, adapt, re-format, modify, publish, translate, license, sub-license, and otherwise make available your User Content for the purpose of providing the service. This includes allowing other users to view and use your content and using your content for promotional or marketing purposes.

11.3. You must ensure that you have the right to grant TwoFingers the license for any third-party content included in your User Content. TwoFingers has no responsibility to evaluate, use, or compensate you for any ideas or information you share.

11.4. TwoFingers’ right to use your User Content does not affect your privacy rights. Please refer to our Privacy Policy for information on how we use your personal information.

11.5. TwoFingers reserves the right to monitor User Content and usernames, and to reject, refuse, or delete any User Content or username that violates the Rules of Acceptable Use or for any reason at our discretion. By using the service, you consent to TwoFingers’ regulation, monitoring, copying, and recording of User Content.

11.6. You acknowledge that offensive, indecent, or objectionable material may exist on TwoFingers. TwoFingers is not responsible for any User Content uploaded, transmitted, or made available through the service. We do not pre-screen or monitor User Content and assume no obligation to modify, edit, or remove inappropriate content. Your use of the service is at your own risk.

Rules of Acceptable Use:

When using TwoFingers, you must adhere to specific rules outlined below:

12.1. You must not circumvent, impair, disable, or interfere with any security features of the service.

12.2. Do not provide false or misleading information or impersonate others when using TwoFingers.

12.3. Do not use the service if you have been suspended or banned.

12.4. Do not engage in illegal, improper, or unlawful conduct that causes harm to others or property.

12.5. Do not modify, interfere with, disrupt, or hack the service.

12.6. Do not misuse the service by introducing viruses or harmful material.

12.7. Do not collect data from the service except as permitted.

12.8. Do not submit User Content that contains nudity, violence, or offensive material.

12.9. Do not submit User Content that infringes on third-party rights, including copyright or trademark.

12.10. Do not submit User Content about another person without their permission.

12.11. Do not harass, threaten, or invade the privacy of others.

12.12. Do not use automated systems to access the service beyond human capability.

12.13. Do not use the service for marketing purposes.

12.14. Do not engage in unlawful activities using the service.

Failure to comply with these rules may result in suspension of your account or legal action by TwoFingers.

12.15. Failing to follow the Rules of Acceptable Use is a serious violation of these Terms of Service and could lead to various actions from our side, with or without prior notice:

(a) Your access to the relevant TwoFingers app or any part of the TwoFingers Service might be suspended immediately, temporarily, or permanently.

(b) Any content you have posted may be immediately, temporarily, or permanently removed.

(c) We might issue a warning to you.

(d) Legal actions may be taken against you, including reimbursement for any costs incurred due to the breach, such as administrative and legal costs.

(e) If necessary, we may disclose relevant information to law enforcement authorities.

12.16. The actions mentioned in paragraph 12.15 are not exhaustive, and we reserve the right to take any other appropriate action at our discretion.

Notice and takedown policy If you encounter any inappropriate content while using TwoFingers, please reach out to us at support@twofingers.app or ask a trusted adult for assistance.

13.1. If you believe that any content available through the TwoFingers Service infringes your rights or violates our Rules of Acceptable Use, you may contact us by sending an email to support@twofingers.app. Your notice should include the following information:

(a) Your name and contact details, including a valid email address.

(b) If your claim pertains to copyright infringement, identify the work(s) allegedly infringed.

(c) Provide a detailed explanation of why you believe the content violates your rights or our Rules of Acceptable Use.

(d) Include a link or other means of identifying the problematic content.

(e) If your claim involves copyright infringement, include a statement affirming that you have a good faith belief that the use of the material is not authorized by the copyright owner or the law, and that the information in your notice is accurate, under penalty of perjury.

13.2. Upon receiving your notice, we will assess the situation and take appropriate action within a reasonable timeframe, at our discretion.

Closing your account Should you wish to permanently deactivate your TwoFingers account, please inform us at support@twofingers.app or through the TwoFingers App directly.

We may also close your account if you violate our terms or policies.

14.1. If, at any time, you find yourself unable to agree to these Terms of Service or any updates made to them, you must cease using the TwoFingers Service immediately and delete the TwoFingers App.

14.2. Deleting the TwoFingers App may not automatically close your account. Please contact us at support@twofingers.app if you wish to close your account, or you can do so directly through the TwoFingers App.

14.3. We reserve the right to terminate your access to the TwoFingers Service immediately if you breach the Rules of Acceptable Use or any other terms and conditions, including these Terms.

14.4. Upon termination of your access to the TwoFingers Service, we may delete any User Content you have uploaded and any other information we hold about you. You should ensure you keep a personal copy of any User Content.

14.5. Termination of your access to the TwoFingers Service and account closure does not release you from any outstanding monetary obligations to us.

Our responsibility to you

TwoFingers does not take responsibility for third-party content available on the platform. The service is provided “as is” without any warranties.

15.1. While we strive to maintain a reasonable standard and quality of the TwoFingers App, some content on the platform may be owned or developed by third parties, over which we have no control or responsibility.

15.2. The TwoFingers Service may be accessed internationally, but certain features or functions may not be available in all locations or to all users. Additionally, the Service may experience occasional downtime for maintenance or technical reasons.

15.3. The TwoFingers Service is provided on an “as available” and “as is” basis. We do not guarantee uninterrupted, error-free, or secure access to the Service, and we exclude any implied warranties to the fullest extent permitted by law.

15.4. We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the TwoFingers Service, even if we have been advised of the possibility of such damages.

Resolving disputes Any disputes between you and TwoFingers will be handled through arbitration. Please contact us at support@twofingers.app to attempt informal resolution first.

16.1. Any dispute, claim, or controversy arising from or related to the TwoFingers App and Service, including these Terms, will be resolved through binding arbitration.

16.2. Before initiating arbitration, please contact us at support@twofingers.app to attempt to resolve the dispute informally. If an informal resolution is not reached within ninety days, either party may initiate arbitration.

16.3. The arbitration will be conducted in accordance with the rules of JAMS, and the arbitrator’s decision will be binding and may be entered as a judgment in any court of competent jurisdiction.

Changes to the TwoFingers Service

You acknowledge that the TwoFingers Service and its features may change over time.

17.1. We continually update and improve the TwoFingers Service to provide new features and services. These updates may affect your past activities and user content on the platform.

17.2. We may make changes to the TwoFingers Service, including removing or discontinuing features, as necessary to reflect technological advancements or business needs.

17.3. Your continued use of the TwoFingers Service constitutes acceptance of any changes made to it.

Changes to the terms You understand that these Terms of Service may be updated periodically.

18.1. We reserve the right to revise these Terms of Service as needed, with the most current version available on our website or within the TwoFingers App.

18.2. Changes to the Terms may occur due to new features, legal requirements, or clarifications.

18.3. Your continued use of the TwoFingers Service after any updates indicates your acceptance of the revised Terms.

Indemnity

You agree to indemnify and hold TwoFingers harmless from any claims arising from your use of the TwoFingers App or Service or any breach of these Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
